What If It Could Be Better....!

When I was a litigation barrister, I had a client walk into my office for a conference.
We spoke for about 10 minutes, and then I noticed him put his hand into his pocket.
He pulled out a dark blue handkerchief with knots tied in it, holding its contents inside.
He laid it on my table and untied every knot, slowly.
Inside were about 30- 40 human teeth.
I wanted to throw up.
That can be the same feeling when you get that insulting settlement offer at mediation. Your stomach drops.
The problem? Most lawyers lack a clear strategy for staying confident and calm in the face of anything being thrown at them.
Look, too many lawyers walk into mediation thinking they already know how the other side will act.
They rehearse imaginary conversations.
Make up stories about every offer.
Treat each offer like it's a marriage proposal that needs months of analysis.
All that energy on things that don't 100% matter.
Then what happens?
Premature concessions.
Money left on the table.
People get triggered, and it gets heated.
Why? Most are negotiating with a version of the other side in their head, without a strategy to handle whatever comes their way.
You'll never hear a lawyer admit they're scared in mediation.
But as a mediator, I see it.
The overthinking.
The second-guessing.
The control, force and aggression.
"What if I refuse this offer and look like an idiot?"
"What if someone thinks I'm incompetent?"
That's not a winning strategy.
That's many lawyers' brains at 2 am before a tough mediation.
